These conditions of sale are concluded on the one hand by the company Vert Nature. with a capital of 8000 euros whose registered office is at Mas de Malrives 34820 TEYRAN, Tel: +33 (0)4 67 29 30 52 , Mel:infos@vertnature.fr, registered in the Montpellier trade and companies register under number 495 155 442 hereinafter referred to as "Vert Nature" and on the other hand, by any natural or legal person wishing to make a purchase via the Vert Nature website hereinafter referred to as "the buyer".
Object
These conditions of sale are intended to define the contractual relationship between Vert Nature and the buyer and the conditions applicable to any purchase made through the merchant site of Vert Nature, whether the buyer is a professional or a consumer. The acquisition of a product through this site implies unreserved acceptance by the buyer of these conditions of sale.
These conditions of sale shall prevail over any other general or specific conditions not expressly approved by Vert Nature. Vert Nature reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.
Characteristics of the goods and services offered
The products offered are those listed in the catalog published on the Vert Nature website. These products are offered within the limits of available stocks. Each product is accompanied by a description with photo.
The photographs in the catalog are as faithful as possible but cannot ensure perfect similarity with the product offered, particularly with regard to colors.
Prices
The prices listed in the catalog are net prices in euros resulting from the VAT exemption applicable to Vert Nature under article 293B of the general tax code; any change in the rate may be passed on to the price of the products or services. Vert Nature reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated include the costs of order processing, transport and delivery insofar as they take place in the geographical areas provided by Vert Nature.
Geographical area
The online sale of products and services presented on the site is reserved for buyers who reside in France, in the overseas departments and territories or in Monaco, as well as in the countries bordering metropolitan France (Belgium, Holland, Switzerland, Germany, Italy , Spain, Portugal) and for deliveries required in these geographical areas.
Orders
The buyer, who wishes to buy a product, must:
- create his Customer account by completing the online identification form on which he will indicate all the requested details;
- complete the online order form by selecting all the references of the chosen products;
- validate his order after having checked it;
- make the payment under the conditions provided;
- confirm their order and payment and correct them if necessary in view of the summary provided. Confirmation of the order entails acceptance of these conditions of sale, acknowledgment of having perfect knowledge of them and waiver of its own conditions of purchase or other conditions. All the data provided and the recorded confirmation will constitute proof of the transaction. Confirmation will be worth signing and acceptance of transactions. The seller will communicate by e-mail confirmation of the registered order.
Vert Nature also accepts, by temporary derogation, any order sent by post and accompanied by the aforementioned identification and order information on a handwritten order form, as well as their payment by check or bank transfer.
Withdrawal
The buyer benefits from a withdrawal period of fourteen days from the delivery of his order to return the unopened product to Vert Nature for exchange or refund without penalty, with the exception of return costs. The product will be refunded to him within 30 days after receipt and integrity check by Vert Nature.
Payment terms
The full price is payable when ordering.
Payments will be made at the choice of the buyer by credit card, check or bank transfer.
Payments made by credit card will be made through the ATOS secure system which uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and no third party can read it during the transaction. transport on the network. The order to debit the buyer's account is then transmitted within 24 hours maximum to our bank.
In the event of payment by cheque, this will only be sent for collection when the products are dispatched.
A paper invoice is provided with each shipment. The buyer can also download it at any time from his customer area, once his actual payment has been recorded.
Deliveries
Shipments are made within 2 working days to the address indicated in the order form which can only be in the agreed geographical area. The risks are the responsibility of the purchaser from the moment the products have left the premises of Vert Nature, attested by the certificate of acceptance of the chosen carrier that Vert Nature can produce on simple request.
In the event of incorrect or incomplete address not allowing the distribution of the parcel by the conveyor, the expenses of reforwarding will be the responsibility of the purchaser.
In the event of damage during transport, the reasoned protest must be made by the buyer to the carrier he has chosen, within three days of delivery.
Delivery times are only given as an indication; if these exceed thirty days from the order, and at least 10 days after the buyer has informed Vert Nature in writing, the sales contract may be terminated and the buyer reimbursed.
Guarantee
All the products supplied by the seller benefit from the legal guarantee provided for by articles 1641 and following of the Civil Code. In the event of non-compliance of a product sold, it may be returned to the seller who will take it back, exchange it or refund it. All complaints, requests for exchange or reimbursement must be made by post to Vert Nature's address within thirty days of delivery.
Responsibility
The seller, in the online sales process, is only bound by an obligation of means; its liability cannot be engaged for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other involuntary problems. Intellectual property All elements of the Vert Nature site are and remain the exclusive intellectual property of Vert Nature.
No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or sound. Any simple or hypertext link is strictly prohibited without the express written consent of Vert Nature.
Personal data
In accordance with the law relating to data processing, files and freedoms of January 6, 1978, information of a nominative nature relating to buyers may be subject to automated processing. Vert Nature reserves the right to collect information on buyers, including by using cookies, and, if it wishes, to transmit the information collected to business partners.
Buyers may object to the disclosure of their details by notifying Vert Nature. Similarly, users have the right to access and rectify data concerning them, in accordance with the law of January 6, 1978. The automated processing of information, including the management of the e-mail addresses of users of the site was the subject of a declaration to the CNIL on August 14, 2014 registered under No. 1787972.
Archiving - Proof
Vert Nature will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code. The computerized registers of Vert Nature will be considered by the parties as proof of communications, orders, payments and transactions between the parties.
Litigation
These online sales conditions are subject to French law. In the event of a dispute, jurisdiction is assigned to the competent courts of Montpellier, notwithstanding multiple defendants or warranty claims.
