Terms and Conditions of Sale

1. Company Information

These terms and conditions are concluded between, on the one hand, the company Vert Nature, SARL with a share capital of 1,000 euros, whose registered office is located at Mas de Malrives 34820 Teyran, registered with the Montpellier Trade and Companies Register under number 532 501 012, email: infos@vertnature.fr, telephone: +33 6 68 57 14 42, hereinafter referred to as “the Seller”, and, on the other hand, any natural or legal person wishing to make a purchase via the Seller's website, hereinafter referred to as “the Customer”.

2. Purpose

These terms aim to define the contractual relationship between Vert Nature and the Customer, as well as the conditions applicable to any purchase of moxibustion products (moxas, accessories, supports, etc.) made via the website www.vertnature.fr. These products are intended solely for well-being purposes and are not medical devices within the meaning of applicable regulations.

3. Products

The products offered are those listed on the website www.vertnature.fr, subject to availability. Each product is accompanied by a description and, where applicable, usage precautions. The photographs are as accurate as possible but are not contractually binding.

Warning: Moxas and moxibustion accessories must be used with caution and only by individuals trained or supervised by a competent professional. Improper use may pose a risk of burns or fire. The Seller declines all responsibility in the event of misuse.

The products are not intended to be ingested (infusions, food preparations, etc.) or smoked.

4. Prices

Prices are expressed in euros, inclusive of all taxes (not subject to VAT under article 293 B of the French Tax Code). Vert Nature reserves the right to change its prices at any time. The applicable price is the one displayed at the time of the order.

5. Orders

To validate an order, the Customer must:

  • Fill out the identification form or log in to their customer account;
  • Select the desired products and complete the online order form;
  • Check and validate their order;
  • Accept these Terms and Conditions;
  • Make payment via a method offered on the website.

Order validation implies acceptance of these Terms and Conditions and constitutes proof of the transaction.

6. Right of Withdrawal

In accordance with the law, the Customer has fourteen (14) days from receipt to exercise their right of withdrawal without having to give any reason or pay penalties, provided that the products are returned in their original packaging, unopened and unused. For hygiene reasons, any opened or damaged product cannot be refunded. Return shipping costs are the responsibility of the Customer.

7. Payment

Payment is required upon ordering and may be made by bank card or any other secure method offered on the website. Payment data is encrypted and processed by a specialized provider.

8. Delivery

Products are shipped to the address indicated at the time of the order. Delivery times are indicative and may vary depending on the carrier. The Seller shall not be held liable for delays due to the carrier or exceptional circumstances.

9. Warranty and Conformity

Products benefit from the legal guarantee of conformity (articles L217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (articles 1641 et seq. of the French Civil Code). The warranty does not cover damage resulting from improper use or negligence by the Customer.

10. Liability

The Seller shall not be held liable for any bodily injury or material damage resulting from misuse of moxas or accessories sold. Products are not intended to diagnose, treat, or cure any disease. Any use for therapeutic purposes is the sole responsibility of the user or practitioner.

11. Personal Data

Personal data is collected in compliance with the GDPR and solely for the purpose of managing orders and customer relations. The Customer has the right to access, rectify, and delete their data by contacting infos@vertnature.fr.

12. Archiving – Proof

Orders and invoices are archived on a reliable and durable medium. The Seller’s computerized records shall be considered proof in the event of a dispute.

13. Dispute Resolution

These Terms and Conditions are governed by French law. In the event of a dispute, the competent courts of Montpellier shall have exclusive jurisdiction. The Customer also has the option of using a consumer mediator.
